The terms “Fnxdg,” “we,” “us,” and “our” refer to the operator of this online store. Fnxdg provides this website, including its information, content, features, tools, products, and related services (collectively, the “Services”), to customers who access or use www.fnxdg.com.

Our store is powered by Shopify, which provides the ecommerce platform used to make the Services available.

These Terms of Service (“Terms”) describe the rights and responsibilities that apply when you access or use the Services, browse our website, create an account, communicate with us, or place an order.

To use certain features or place an order, you may be required to provide information including your name, email address, phone number, billing address, shipping address, and payment information.

You agree that information you provide will be current, complete, and accurate and that you have the authority to provide and use that information.

If customer accounts are available, you are responsible for:

  • Maintaining the confidentiality of your account credentials

  • Restricting unauthorized access to your account

  • Keeping your account information current

  • Notifying us if you believe your account has been accessed without authorization

You may not sell, transfer, assign, or license your customer account to another person.

We may restrict or terminate account access when reasonably necessary to protect the Services, prevent fraud, comply with law, or address a violation of these Terms.

Section 2 — Products and Product Information

We make reasonable efforts to display and describe our products accurately.

Product colors and appearance may vary slightly depending on:

  • Device type

  • Screen settings

  • Lighting

  • Photography

  • Product materials

  • Manufacturing or production variations

Product descriptions, measurements, materials, care instructions, availability, and other information are provided for general purchasing guidance. Customers should review the complete product page, including any item-specific sizing information, before placing an order.

We may update product information, correct errors, limit quantities, or discontinue products when reasonably necessary.

Nothing in this section excludes any product warranty or consumer right that cannot legally be excluded.

Section 3 — Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automatically generated order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been finally accepted or shipped.

An order is subject to:

  • Successful payment authorization

  • Product availability

  • Fraud and security review

  • Accurate billing and shipping information

  • Compliance with these Terms and applicable law

We may decline, hold, or cancel an order when:

  • Payment cannot be authorized

  • A product is unavailable

  • Pricing or product information contains a material error

  • The order is identified for additional fraud or security review

  • Shipping information is incomplete or invalid

  • The order appears to violate these Terms or applicable law

If we decline or cancel an order after payment has been collected, we will issue an applicable refund to the original payment method.

We will make reasonable efforts to notify you using the email address or phone number provided during checkout.

Orders are intended for personal or household use. You may not purchase products for unauthorized commercial resale, fraudulent export, or other unlawful purposes.

Section 4 — Order Changes and Cancellations

Please review your order carefully before completing checkout.

If you need to request a change or cancellation, contact us as soon as possible at hello@fnxdg.com.

We will make reasonable efforts to assist, but changes and cancellations cannot be guaranteed after an order has entered processing.

Once an order has shipped, it cannot be canceled or modified. Eligible products may instead be returned after delivery in accordance with our Return and Refund Policy.

Section 5 — Prices, Currency, and Billing

Unless another currency is clearly displayed, prices on our website are listed in United States Dollars (USD).

The final checkout total may include:

  • Product prices

  • Applicable discounts

  • Shipping charges, if any

  • Applicable sales taxes

  • Other charges clearly disclosed before payment

Fnxdg currently offers free standard shipping on eligible United States orders, as described in our Shipping Policy.

Prices, discounts, and promotional offers may change without prior notice. The price applied to an order is the price displayed and accepted at checkout, subject to correction of material errors.

You agree to provide current, complete, and accurate purchase and billing information.

You represent that:

  • You are authorized to use the selected payment method

  • The payment information you provide is accurate

  • Charges associated with your order may be submitted to the payment provider

  • You are responsible for the final amount shown and accepted at checkout

If your payment method uses a currency other than USD, your bank or payment provider may apply conversion rates or additional fees. Fnxdg does not control fees charged by your financial institution.

Section 6 — Promotions and Discount Codes

Promotions and discount codes may be subject to separate eligibility requirements, expiration dates, exclusions, or other conditions.

Unless otherwise stated:

  • Promotional codes must be entered before checkout is completed

  • Only one promotional code may be used per order

  • Promotional codes cannot be exchanged for cash

  • Expired or invalid codes will not be applied

  • Some products may be excluded from promotions

  • Discounts generally cannot be added after an order has been submitted

If promotional terms conflict with these Terms regarding the applicable promotion, the specific promotional terms will control.

We may cancel or refuse a promotion that has been used fraudulently, unlawfully, or contrary to its stated terms.

Section 7 — Shipping and Delivery

Fnxdg currently ships to eligible addresses within the United States.

Applicable shipping terms include:

  • Free standard shipping on eligible United States orders

  • Order cutoff time of 12:00 AM Eastern Time

  • Processing time of 1–3 business days, Monday–Friday

  • Estimated transit time of 6–9 business days, Monday–Friday

  • Estimated total delivery time of 7–12 business days

Delivery dates are estimates and are not guaranteed.

Carrier disruptions, severe weather, public holidays, address errors, transportation delays, and other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate shipping address. Address changes cannot be guaranteed after fulfillment begins.

Orders may be processed or shipped by third-party fulfillment partners and carriers. The shipment origin may differ from the Fnxdg business contact address.

Ownership and risk relating to shipped products will be determined according to applicable law. Nothing in these Terms removes any responsibility Fnxdg has for properly fulfilling an accepted order.

Section 8 — Returns, Exchanges, and Refunds

Eligible United States orders may be returned or exchanged within 30 days after delivery in accordance with our Return and Refund Policy.

Unless otherwise stated in that policy:

  • Returns are accepted for eligible defective and non-defective products

  • Returned products must be in new condition

  • Returns and exchanges are completed by mail

  • The customer is responsible for obtaining and paying for the return shipping label

  • No restocking fee is charged

  • Approved refunds are processed to the original payment method within 3 business days after inspection and approval

Bank or payment provider posting times may apply after a refund has been processed.

Section 9 — Intellectual Property

The Services and their content—including text, graphics, logos, page designs, photographs, videos, audio, software, and the selection and arrangement of content—are owned by or licensed to Fnxdg, Shopify, or their respective content providers and may be protected by copyright, trademark, and other intellectual property laws.

These Terms grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Services for lawful personal and non-commercial purposes.

Without prior written permission from the applicable rights holder, you may not:

  • Copy, reproduce, republish, or distribute protected content

  • Modify or create derivative works from protected content

  • Use Fnxdg branding in a way that suggests unauthorized affiliation

  • Remove copyright, trademark, or ownership notices

  • Use website content for unauthorized commercial purposes

  • Download, scrape, or extract substantial portions of the Services

No provision of these Terms grants you ownership of or a license to any trademark, copyright, patent, or other intellectual property except for the limited access expressly described above.

Shopify’s names, logos, and service marks belong to Shopify. Other names and marks displayed through the Services belong to their respective owners.

Section 10 — Optional Third-Party Tools

The Services may provide access to tools, features, applications, or integrations supplied by third parties.

Third-party tools may be provided “as available” and may be governed by the provider’s own terms and privacy policies.

Fnxdg does not control every aspect of third-party tools and is not responsible for a third party’s independent acts, omissions, availability, or data practices, except to the extent otherwise required by applicable law.

Before using an optional third-party tool, you should review the applicable provider’s terms and privacy policy.

New tools and features introduced through the Services may also be subject to these Terms.

Section 11 — Third-Party Links

The Services may contain links to websites or platforms operated by third parties.

Fnxdg does not control and is not responsible for the content, accuracy, privacy, security, availability, or business practices of unaffiliated third-party websites.

Visiting an external website is at your own discretion. You should review the third party’s terms, privacy policy, return policy, and other applicable conditions before submitting information or completing a transaction.

A link does not necessarily mean that Fnxdg endorses or is affiliated with the applicable third party.

Concerns regarding a product or service purchased directly from an unrelated third party should be directed to that third party.

Section 12 — Relationship With Shopify

Fnxdg is powered by Shopify, which provides the ecommerce platform used to make the Services available.

Purchases made through the Fnxdg store are transactions directly between the customer and Fnxdg. Shopify is not the seller of Fnxdg products and is not responsible for the products sold by Fnxdg.

To the fullest extent permitted by applicable law, you acknowledge that Shopify and its affiliates are not responsible for claims arising solely from products purchased directly from Fnxdg.

Nothing in this section limits any right or remedy that cannot lawfully be limited.

Section 13 — Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes information relating to your access to and use of the Services to provide, protect, and improve its platform and related services.

Information submitted through the Services may be shared with Shopify and applicable service providers, including providers located outside the country in which you reside.

Section 14 — Customer Feedback and Reviews

If you submit a product review, suggestion, idea, photograph, comment, or other feedback (“Feedback”), you grant Fnxdg a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, publish, display, adapt, and distribute the Feedback for purposes including operating, improving, and promoting the Services.

This license does not transfer ownership of your Feedback to Fnxdg.

You represent that:

  • You own the Feedback or have permission to submit it

  • The Feedback is accurate and based on your genuine experience where applicable

  • You have disclosed any compensation or incentive received for the Feedback

  • The Feedback does not violate another person’s intellectual property, privacy, publicity, or other rights

  • The Feedback does not contain unlawful, abusive, misleading, defamatory, obscene, or malicious content

Fnxdg may moderate or remove Feedback that violates these Terms, applicable law, or our content standards.

We are not obligated to pay for, respond to, or keep Feedback confidential unless otherwise agreed in writing.

Section 15 — Errors, Inaccuracies, and Omissions

Occasionally, the Services may contain typographical errors, inaccurate information, or omissions concerning:

  • Product descriptions

  • Prices

  • Promotions

  • Availability

  • Shipping charges

  • Delivery estimates

  • Product images or specifications

We may correct errors and update information when reasonably necessary.

If a material pricing or availability error affects an order, we may contact you for instructions or cancel the affected order and issue an applicable refund to the original payment method.

Nothing in this section permits Fnxdg to avoid an accepted obligation or consumer right that cannot legally be excluded.

Section 16 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate applicable laws or regulations

  • Infringe the intellectual property or other rights of Fnxdg or another party

  • Submit false, misleading, fraudulent, or impersonating information

  • Harass, threaten, abuse, defame, or unlawfully discriminate against another person

  • Upload or transmit viruses, malware, or harmful code

  • Interfere with the security or operation of the Services

  • Collect or track another person’s personal information without authorization

  • Send spam, phishing messages, or unauthorized solicitations

  • Make fraudulent purchases or payment disputes

  • Circumvent access controls, security measures, or technical restrictions

  • Copy, scrape, extract, sell, or commercially exploit the Services without authorization

  • Use the Services in any way that could damage Fnxdg, Shopify, customers, or service providers

We may suspend or terminate access where we reasonably determine that these Terms have been materially violated.

Nothing in this section prevents legally protected activity or the lawful exercise of consumer rights, including contacting a bank or payment provider about a genuine billing dispute.

Section 17 — Automated Agents

This section applies to automated or semi-automated software or services (“Agents”) that access or interact with the Services on behalf of another person or entity.

An Agent may not:

  • Conceal that it is operating through automated means

  • Misrepresent itself as a human

  • Circumvent CAPTCHAs, access controls, or technical restrictions

  • Ignore a request to stop accessing the Services

  • Use the Services in violation of these Terms or applicable law

Where technically applicable, an Agent must accurately identify itself and comply with the access requirements communicated by the Services.

We may use reasonable technical measures to limit, modify, or block automated access that violates these Terms.

Section 18 — Suspension and Termination

We may suspend or terminate access to the Services when reasonably necessary because of:

  • Fraudulent or unlawful activity

  • A security threat

  • Misuse of the Services

  • A legal or regulatory requirement

  • Discontinuation of a relevant service

Termination does not affect rights or obligations that arose before termination.

Provisions relating to intellectual property, feedback, disclaimers, liability, indemnification, governing law, privacy, and other provisions that by their nature should survive will continue after termination.

Section 19 — Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis.

We do not guarantee that:

  • The Services will always be uninterrupted or error-free

  • Every defect will be corrected immediately

  • Every product will remain continuously available

  • Website information will always be free from minor technical or typographical errors

Products remain subject to the descriptions, policies, and legally required warranties applicable to their sale.

Nothing in these Terms excludes or limits warranties, guarantees, or consumer rights that cannot lawfully be excluded or limited.

Section 20 — Limitation of Liability

To the fullest extent permitted by applicable law, Fnxdg and its service providers will not be liable for indirect, incidental, special, punitive, or consequential damages resulting from the use of or inability to use the Services.

This may include loss of profits, revenue, savings, data, or business opportunity where such damages were not reasonably foreseeable or where liability may legally be limited.

Fnxdg’s liability will not be excluded or limited for:

  • Fraud or fraudulent misrepresentation

  • Willful misconduct

  • Liability that cannot be excluded under applicable law

  • Any non-waivable consumer right or remedy

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

Section 21 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Fnxdg, Shopify, and their applicable affiliates, employees, contractors, licensors, and service providers from third-party claims arising from:

  • Your material violation of these Terms

  • Your unlawful use of the Services

  • Your infringement of another party’s legal rights

  • Content or Feedback you submit in violation of these Terms

This obligation does not apply to claims caused solely by Fnxdg’s own unlawful conduct, negligence, or breach of these Terms.

We will provide reasonable notice of an indemnifiable claim and may control its defense and settlement, provided that we will not impose a non-monetary obligation on you without your reasonable consent.

Section 22 — Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed from these Terms.

The remaining provisions will remain in effect.

Section 23 — Waiver and Entire Agreement

A failure by Fnxdg to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies and rules incorporated by reference, constitute the entire agreement between you and Fnxdg regarding use of the Services and supersede prior communications concerning the same subject matter.

Any ambiguity will be interpreted fairly and in accordance with applicable law.

Section 24 — Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

Fnxdg may assign or transfer its rights and obligations in connection with a merger, acquisition, sale of assets, restructuring, or similar business transaction, subject to applicable law.

No assignment will reduce a customer’s rights under an accepted order or applicable consumer law.

Section 25 — Governing Law

These Terms and any separate agreement through which Fnxdg provides the Services are governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles.

Subject to applicable consumer protection law, legal proceedings relating to these Terms may be brought in the state or federal courts serving Tarrant County, Texas.

If the law of your place of residence provides mandatory consumer protections or dispute rights, nothing in this section removes those protections or rights.

You can review the current version of these Terms at any time on this page.

We may update these Terms to reflect changes to:

  • The Services

  • Our business practices

  • Our policies

  • Applicable laws or regulations

  • Security or operational requirements

When changes are made, we will post the revised Terms and update the “Last Updated” date.

Material changes will be communicated when required by applicable law. Changes will apply from the stated effective date and will not retroactively remove rights relating to orders placed before that date.
